Please read and understand the Terms and Conditions of Nanhi Gudiya carefully. The Terms and Conditions, as well as policies regarding Privacy, Fees, Payments, Promotions, Delivery, Returns, and Refund, together shall constitute the entire Terms of Use.

**Why these documents?**

  1. These Terms of Use, read together with the (a) Privacy Policy, (b) Fee and Payment Policy, (c) Delivery Policy,  and (d) Return and Refund Policy, constitute a legal and binding agreement between you and Nanhi Gudiya, a company incorporated under the laws of India, with its registered office at Shop No.2261, 2nd Floor, Hawkers Plaza, S.B. Marg, Dadar(West), Mumbai-400028. Maharashtra , India.
  1. The Terms of Use govern your access to and use of (i) Nanhi Gudiya’s website, nanhigudiya.com, and its mobile and tablet applications (“Platforms”), (ii) Nanhi Gudiya’s online solutions for lifestyle, fashion, and electronics, enabling the purchase of merchandise such as lifestyle, fashion items, and other products (“Products”) through the Platforms, and (iii) any additional services provided by Nanhi Gudiya from time to time (collectively referred to as the “Services”).
  1. By accessing, browsing, or purchasing Products and using Services on Nanhi Gudiya’s platform, you agree to be bound by the Terms of Use, forming a binding contract between Nanhi Gudiya and all Users. If you do not agree to these terms, please refrain from using the Services or purchasing Products. The Terms of Use must be accepted without modification, and using the Services implies acceptance of these terms.

**Terms and conditions applicable to users**

  1. Users must be 18 or older to register, visit, or use the Services. By doing so, you confirm you are 18 or older and agree to the Terms of Use. Users under 18 must be supervised by a parent or guardian who agrees to the Terms of Use. If Nanhi Gudiya learns an underage user is unsupervised, the account may be deactivated without notice.
  1. All content on the Services, including text, graphics, logos, and software, is owned by Nanhi Gudiya and protected by law. You may not modify, reproduce, distribute, or use this content for public, commercial, or personal gain.
  1. Nanhi Gudiya allows you to view and use its content only for identifying products, making purchases, and processing returns. This limited permission does not include resale, commercial use, or derivative use of the content.
  1. To help users choose products, Nanhi Gudiya offers visual aids like images and videos. While we strive for accuracy, we can’t guarantee that these visuals will match the delivered product exactly. The actual product may vary.
  1. Users can make purchases and register on the Platforms. Nanhi Gudiya may collect personal information like your name, email, phone number, and address for identification. Registration is one-time, and you must keep your username and password confidential. If you forget them, use the “forgot username/password” option to retrieve and change them.
  1. Users are responsible for any risks, liabilities, and consequences if their account is accessed illegally. Any purchases made through unauthorized access must be paid for by the User.
  1. Displaying products on the Platforms is an invitation to offer. A user’s order is an offer, subject to product availability, Nanhi Gudiya’s acceptance, and the user’s adherence to the Terms of Use.
  1. You agree to keep your information true, accurate, current, and complete. If your information is found to be false or incomplete, Nanhi Gudiya may suspend, terminate, or block your access to the Platforms.
  1. Nanhi Gudiya’s rights and liabilities are limited to the Terms of Use. You must also comply with third-party terms linked in the Services. Nanhi Gudiya is not liable for transactions between you and third parties.
  1.  When you register or purchase on the Platforms, you may receive messages or emails from Nanhi Gudiya about your registration, order status, payments, dispatch details, and promotions. A confirmation message or email is not an acceptance of your order. Acceptance occurs only when the product is dispatched and you receive a confirmation message or email. Nanhi Gudiya reserves the right to limit or cancel orders before dispatch.
  1.  Nanhi Gudiya will communicate with you through your registered mobile number and/or email address, or any other contact details you provide for specific transactions. It’s your responsibility to update these details on the Platforms if they change. Nanhi Gudiya may also send notifications and reminders about scheduled deliveries. While efforts will be made to send these promptly, Nanhi Gudiya is not liable for any failure to do so.
  1. Nanhi Gudiya reserves the right to upgrade, update, modify, or improve the Services without prior notice. Changes to the Terms of Use will also apply to all Users. You agree to stay updated and review the Terms of Use periodically. Changes become effective when posted. Nanhi Gudiya may alter or remove Platform content without notice.
  1. Nanhi Gudiya strives to maintain high-security standards and provide uninterrupted Services but is not liable for interruptions to your access or use of the Services.
  1. Access to and registration on the Platforms is currently free of cost. However, Nanhi Gudiya reserves the right to introduce fees for access, browsing, or new services without prior notice to Users.

**User covenants and obligations**

  1. As mandated under the provisions of Regulation 3(2) of the IG Rules, Nanhi Gudiya hereby informs you that you are prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, updating, or sharing any information that:
  • Belongs to another person and to which you do not have any right;
  • is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another’s privacy, hateful, or racially, ethnically objectionable, disparaging, relating to or encouraging money laundering or gambling, or otherwise harmful in any manner whatsoever;
  •  harms minors in any way;
  •  infringes any patent, trademark, copyright, or other proprietary rights;
  • violates any law for the time being in force;
  •  deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
  • impersonates or defames another person; or
  • contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer resource.
  1. You are also prohibited from:
  •  violating or attempting to violate the integrity or security of the Platforms or the Nanhi Gudiya Content;
  •  transmitting any information on or through the Platforms that is disruptive or competitive to the provision of Services by Nanhi Gudiya;
  •  intentionally submitting on the Platforms, false or inaccurate information;
  • using any engine, software, tool, agent, or other mechanism (such as spiders, robots, avatars, worms, time bombs, Easter eggs, cancel bots, intelligent agents, etc.) to navigate or search the Platforms;
  • attempting to decipher, decompile, disassemble, or reverse engineer any part of the Platforms; or
  • copying or duplicating in any manner any of the Nanhi Gudiya Content.
  1. You are also obligated to:
  •  refrain from acquiring any ownership rights by downloading the Nanhi Gudiya Content;
  • read the Terms of Use and agree to accept the terms and conditions set out therein;
  • refrain from copying or modifying the Nanhi Gudiya Content available on the Platforms for any purpose;
  •  comply with all applicable laws in connection with your use of the Platforms;
  • not refuse the delivery of purchased Products except when damages and deficiencies can be identified upfront at the time of delivery; and
  • use the Products for personal, non-commercial use.

3)  You hereby authorize Nanhi Gudiya to declare and provide declarations to any Governmental authority on request on your behalf, including that the Products ordered by you are for personal, non-commercial use.

  1. Nanhi Gudiya may disclose or transfer information provided by you to its affiliates in India and other countries, and you hereby consent to such transfer. In terms of the SPI Rules, Nanhi Gudiya can transfer sensitive personal data or information to any other body corporate or a person that ensures the same level of data protection that is adhered to by Nanhi Gudiya as provided for under the SPI Rules, only if such transfer is necessary for the performance of the lawful contract between Nanhi Gudiya or any person on its behalf and the User or where you have consented to such data transfer.

**Third-party information**

All information in relation to third parties as available on the Platforms (collectively referred to as “Third Party Information”) are provided solely for your reference. Nanhi Gudiya is not endorsing the Third Party Information and is not responsible for any errors and representation nor is it associated with it and you shall access the Third Party Information at your own risk. Further, it is up to you to take sufficient precautions to ensure that whatever links you select, whether from the Platforms, or other Services, is free of such items such as, but not limited to, viruses, worms, Trojan horses, defects, and other items of a destructive nature.

**Intellectual property rights**

All the intellectual property used on the Platforms by Nanhi Gudiya, including the Nanhi Gudiya Content, shall remain the property of Nanhi Gudiya, its parent company, group companies, subsidiaries, associates, affiliates, suppliers, vendors, sister companies, or of any third party hosting such intellectual property on the Platforms. Except as provided in the Terms of Use, the materials may not be modified, copied, reproduced, distributed, republished, downloaded and displayed.
